1. Operator and contact
- The service provider and operator of NeuroHackingApp.com (the “Service”) is BOMEGA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Długa 2B, 56-416 Twardogóra, Polska. - These Terms set out the rules for electronic services made available through the Service.
2. Definitions
- “Account” means an individual user profile protected by authentication and associated with an email address and data stored in the Service.
- “User” means a natural person using the Service who is at least 18 years old.
- “Electronic Services” means functions supplied remotely through the Provider’s information system.
- “Self-observation Data” means information voluntarily entered by the User in features such as Daily Pulse, Focus Lab, experiments, journal, reports, progress and Academy.
- “Telegram Integration” means an optional link between the Account and a supported Telegram bot or Mini App.
- “Notifications” means optional messages sent through Telegram or Web Push according to User settings.
- “Product Documents” include in particular these Terms, the Privacy Policy, Safety and Methodology pages.
3. Nature and scope of the Service
- NeuroHackingApp is an educational platform and a tool for work organization, self-observation, reflection and simple behavioral experiments.
- The Service may provide, among other things, Daily Pulse, Focus Lab, protocols, experiments, journal, reports and exports, Academy, a knowledge base, calculation tools, notification settings and Telegram integration.
- The Service is not a medical device, medical service or psychotherapy. It is not intended to diagnose, treat or prevent disease, or to replace a doctor, psychologist, psychotherapist or other qualified professional.
- Scores, indicators, summaries, correlations and suggestions are educational and supportive only. They do not guarantee a result and do not prove causation.
- Crisis and safety information, where provided, is not made dependent on payment.
4. Technical requirements
- Use of the Service requires an internet-connected device, a current browser supporting HTTPS and JavaScript, and—where Account features are used—access to email.
- Some features may additionally require Service Worker/Web Push support, browser permission for notifications or an active Telegram account.
- Users should keep their operating system and browser current and protect devices and credentials against unauthorized access.
5. Formation of the service agreement and Account registration
- An agreement for Account-related Electronic Services is formed after successful completion of registration and acceptance of the required Product Documents.
- Registration requires at least a valid email address, password and display name, together with required confirmations, including minimum-age confirmation.
- The Service may require email verification through a single-use verification link.
- Users must provide truthful information and may not impersonate another person.
- Users are responsible for keeping passwords confidential and should not share sessions or credentials with third parties.
6. Account use and security
- Users may manage active sessions, log out the current or all sessions, and delete the Account in accordance with available Service functionality.
- If unauthorized Account use is suspected, the User should promptly change access credentials and contact the Provider.
- The Provider may use login-rate controls, single-use tokens, CSRF protection, secure cookies and other technical security measures.
7. Daily Pulse, journal, experiments and reports
- Users may voluntarily record their own observations, including self-ratings of sleep, energy, stress, focus, priorities and personal notes.
- The Service may create summaries and simple comparisons from User data, such as changes over time or co-occurrence of observations.
- Such summaries are not a diagnosis, clinical study or confirmation that one observation caused another.
- A User should stop an experiment or activity if it causes concern, worsens wellbeing or conflicts with advice from a qualified professional.
- The Service should not be used to store medical records, test results, diagnoses or information that the User does not wish to place in an information system.
8. Telegram Integration
- Linking an Account to Telegram is optional unless a particular feature expressly requires that integration.
- Linking may require a single-use code or signed Telegram Mini App mechanism.
- Use of Telegram is also subject to Telegram’s own terms and rules.
- A User may lose access to Telegram-dependent functionality if the link is removed, the Account is deleted or the User loses access to the relevant Telegram account.
9. Email, Telegram and Web Push notifications
- Messages necessary for Account security or operation, such as email verification, may be sent independently of marketing preferences.
- Reminder or product notifications through Telegram and Web Push are configurable in User settings where the function is available.
- Users may disable optional notifications using Service or browser settings.
- The Service may use deduplication, timezone awareness and quiet hours.
10. User content and acceptable use
- Users retain rights in content they enter into the Service to the extent provided by law.
- The User grants the Provider a non-exclusive permission to technically process that content only to the extent required to operate Service functionality, synchronization, backups, export and security.
- Prohibited conduct includes supplying unlawful content, infringing third-party rights, attempting to bypass security, automated overloading of the Service, using another person’s credentials, injecting malicious code or using the Service for unlawful activity.
- Users should minimize personal data relating to other people in notes and free-text fields.
11. Intellectual property
- Rights in the software, interface design, knowledge base, editorial materials, branding and other Service elements belong to the Provider or relevant licensors.
- Use of the Service does not transfer copyright, trademark rights or other intellectual-property rights to the User.
- Materials may be used only within the purpose of Service functionality and applicable law.
12. Availability, changes and maintenance
- The Provider uses reasonable care to maintain a stable and secure Service but does not guarantee uninterrupted availability.
- Interruptions may result from maintenance, updates, failures, infrastructure providers, security incidents or events outside the Provider’s reasonable control.
- Functions may be developed, changed or withdrawn where justified by security, legal compliance, product development or infrastructure changes.
- Material changes affecting User rights should be communicated within a reasonable period before taking effect unless immediate action is required by law or security.
13. Paid services
- If paid functionality or a Premium plan is introduced, the price, billing period, scope and payment rules will be presented before an order is placed.
- Launch of paid functionality may require additional purchase terms and consumer information. Holding an Account does not itself create an obligation to purchase a paid service.
- Until a specific paid offer is activated, this section does not create an obligation to buy or sell any paid service.
14. Complaints and technical support
- Problems with Electronic Services may be reported to [email protected].
- Where possible, a report should include a description of the issue, its date and information needed to reproduce it, without sending passwords, tokens or other secrets.
- The Provider handles complaints within a reasonable period and, where mandatory statutory deadlines apply, within the period required by law.
15. Suspension and termination
- A User may stop using the Account at any time through Account deletion functionality where available or by contacting the Provider.
- The Provider may temporarily limit or suspend an Account where necessary because of a breach of law, these Terms, Service security or third-party rights, proportionately to the issue.
- Serious or repeated breaches may result in termination of Electronic Services, subject to applicable law and consumer rights.
- Account deletion triggers deletion of the active profile according to Service mechanisms and the Privacy Policy; it does not necessarily mean immediate deletion of data that must be retained by law, for claims or because of backup retention cycles.
16. Liability and product boundaries
- The Provider is responsible for Electronic Services under mandatory applicable law.
- The Service does not guarantee a particular outcome in productivity, concentration, wellbeing, stress, sleep, habits or other observed parameters.
- Users make their own decisions about actions based on information in the Service and should consider their own circumstances, safety and relevant professional advice.
- Nothing in these Terms limits consumer rights in a way prohibited by law.
17. Personal data
- Personal-data processing, cookies, browser storage, first-party analytics, Telegram integration and Web Push are described in the Privacy Policy.
- Users may use data-export and Account-deletion functionality according to current Service capabilities.
18. Changes to the Terms
- These Terms may be amended for important reasons including changes in law, functionality, delivery methods, security or operator information.
- Where an Account requires acceptance of a new version, the Service may request renewed acceptance before continued use of selected functions.
- The version of a document and its acceptance may be recorded in the Account.
19. Governing law and consumers
- Services supplied by the Provider are governed by Polish law, without prejudice to mandatory consumer protection provisions applicable in the User’s habitual place of residence where relevant.
- Consumers may use statutory methods for pursuing claims and available out-of-court dispute-resolution procedures.
- Information about consumer rights is available, among other sources, from local consumer ombudsmen and materials of the Polish Office of Competition and Consumer Protection.
20. Final provisions
- The current Terms are made available free of charge in the Service in a manner allowing review before entering into the service agreement.
- If any provision is invalid or ineffective, the remaining provisions remain effective to the extent permitted by law.
- This document takes effect on publication by the Provider.
